A Question of Timing: Did the Recent BARMM Appointments Violate the Spirit of the Law?

The recent appointment of new members to the Bangsamoro Transition Authority (BTA) Parliament by President Ferdinand “Bongbong” Marcos Jr. has raised questions about whether it violates the spirit of the Bangsamoro Organic Law (BOL). While the law grants the president the sole authority to appoint BTA members, including the Interim Chief Minister, the timing of these appointments, just months before the October 2025 BARMM elections, has sparked debate.



Proponents of the appointments argue that the president is simply fulfilling his constitutional duty to ensure the effective functioning of the BARMM government.  They point to the need for a complete and functional BTA Parliament to implement vital programs and projects leading up to the upcoming elections.

However, critics argue that the appointments, especially so close to the elections, could create an uneven playing field and potentially influence the electoral process. They worry that these new appointees might be beholden to the president and could use their positions to advance political agendas that favor the administration.

While the BOL grants the president the power to appoint BTA members, it is crucial to consider the spirit of the law, which emphasizes democratic principles and the autonomy of the Bangsamoro region.  The timing of these appointments raises concerns that they might undermine the very principles of fair and free elections that are essential for the smooth functioning of the BARMM.

- Transparency:  The appointment process should be transparent and free from any perceived political influence.

- Merit-based Selection: Appointees should be chosen based on their qualifications and experience, not on their political affiliations.

- Timely Transition: The appointments should ideally have been made earlier, allowing for a smooth transition period before the elections.

While the president has the authority to make these appointments, it’s crucial to ensure that the process adheres to the spirit of the BOL and upholds the integrity of the upcoming elections.  The BARMM deserves a government that reflects the will of its people, not one influenced by political maneuvering.  This situation presents a critical test of the commitment to the principles of democracy and autonomy within the Bangsamoro region.

It is essential that we prioritize a fair and transparent process that promotes the long-term stability and development of the BARMM, ensuring that the Bangsamoro people have the opportunity to elect their representatives in a free and democratic manner.
